The defendant had previously eluded justice on other occasions, in 2021, when a trial was held against him for the same acts, but also with another defendant who was acquitted. On this occasion, he also did not appear at the hearing.
Both the auxiliary prosecutor and the prosecutor's office wanted JCSM to be sentenced to six years' imprisonment for the crime of fraud under Art. 250.2 of the Criminal Code and a fine of EUR 6,000 . They also demanded that the defendant pay compensation to the two injured brothers in the amount of €630,970 , the real value of the house he had taken from them by trickery.
According to the facts, JCSM acted with a predetermined plan, with which it proceeded to sell the property and appropriate the money obtained in this way. " He took advantage of the fact that the property was mortgaged (...) in the amount of 90,000 euros, in this way and pressured my clients, simple people with little academic background, one of whom suffers from paranoid personality disorder (...) to proceed with the sale of the property, knowing that a bailiff's procedure is pending against the house "- we read in the indictment.
The District Court will set a new date for resolving this trial - the third - when it determines the whereabouts of the accused.
